Terms of engagement

Acceptance

By requesting or confirming an engagement, you agree to these terms and to any written statement of work that accompanies the project. If a statement of work conflicts with these terms, the statement of work prevails for that engagement.

Services

We provide professional claims review, reserve commentary, fraud pattern reporting, and related advisory support. We do not act as your claims adjuster of record, legal counsel, or insurer. Recommendations are advisory unless a statement of work expressly states otherwise.

Client responsibilities

You remain responsible for reserving decisions, SIU referrals, regulatory filings, and communications with insureds, claimants, and regulators. You must provide accurate access to agreed files and notify us of confidentiality constraints.

Intellectual property

Working papers, templates, and methods remain the property of Brookbase Claims Review Co., Ltd.. Deliverables prepared for you may be used internally for your insurance operations. You may not resell our memoranda as a product of another firm without written consent.

Confidentiality

Both parties will protect confidential claim and commercial information and use it only for the engagement, subject to legal compulsion and professional obligations.

Liability

To the fullest extent permitted under the laws of Vietnam, our aggregate liability for an engagement is limited to the fees paid for that engagement. We are not liable for indirect or consequential loss, including lost premium or investment income. Nothing in these terms excludes liability that cannot be limited by law.

Governing law

These terms are governed by the laws of Vietnam. Disputes that cannot be resolved amicably shall be submitted to the competent courts of Ho Chi Minh City.
